A Mangaluru court has granted anticipatory bail to a BJP worker, a director of a cooperative society, from Bantwal taluk, who is accused of sexually harassing a minor girl belonging to Scheduled Caste.
The Additional District and Sessions Judge, Fast Track Sessions Court -1, Mangaluru, Vinay Devaraj, on Monday, granted anticipatory bail to 49-year-old Mahesh Kumar from Manila in Bantwal taluk of Dakshina Kannada.
Kumar is director in Peruvai Vyavasaya Seva Sahakari Sangha. In the compliant registered with Vitla police station, the victim alleged that Kumar approached the girl on January 12 in his agriculture field. By praising her of her beauty, he invited her to a nearby hillock. After leaving the field embarrassed, she filed the compliant on March 25.
The police registered her complaint for offences under Section 12 of Protection of Children from Sexual Offences Act (POSCO), Section 74 of Bharatiya Nyaya Sanhita (BNS), and Section 3(2)(Va) of Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
The accused has been at large since the registration of the complaint. Social organisations held protests seeking his arrest.
Granting anticipatory bail, the judge observed that there was no material on record to infer that Kumar committed the offence only for the reason that she was a member of Scheduled Caste community. The alleged offences were not heinous, which were punishable with more than seven years of imprisonment.
Directing Kumar to appear before the investigation officer within 25 days of the order, the judge said the officer should then release him on bail by obtaining a personal bond for a sum of ₹50,000.
